Terms of Service
By creating an account or using xxsml.com you agree to these terms. If you are using xxsml for a business, you confirm you can bind it to them. If you do not agree, do not use the service. Our Privacy Policy forms part of these terms.
The service
xxsml provides short links, QR codes, link-in-bio pages and click analytics. Features available to you depend on your plan and add-ons. We may change or improve the service, and we will give reasonable notice of changes that remove a paid feature.
Your account
You are responsible for activity under your account and for keeping access to your email secure, since sign-in links go there. Give us accurate information and tell us promptly if you think your account was accessed without permission.
Acceptable use
You may not use xxsml to create links or pages that:
- lead to malware, phishing, scams or deceptive content;
- infringe someone's intellectual property or privacy rights, or are unlawful, harassing, hateful or sexually exploitative;
- hide the real destination to evade a platform's rules, or send spam;
- probe, overload or attempt to break the service, or evade rate limits or abuse checks.
We scan destinations and may warn visitors about, suspend or remove any link, and suspend or close accounts, that we reasonably believe break these rules, with notice where practical.
Your content and data
You keep ownership of the destinations, images and other content you provide. You give us permission to host, process and display it as needed to run the service for you, including redirecting visitors. If you upload a logo you confirm you have the right to use it. You are responsible for your links' content, for telling your visitors what you collect through features such as surveys, lead forms and retargeting pixels, and for getting any consent the law requires.
Plans, billing and cancellation
Paid plans are subscriptions billed monthly in advance through Stripe, at the prices shown at checkout, and renew until cancelled. Changing add-ons mid-cycle may be prorated. You can cancel at any time; the plan stays active until the end of the paid period. Except where the law requires otherwise, fees already paid are not refunded. Accounts set up by an SMBAIGuy representative or by gift code follow the plan and period shown on the account.
Availability and links stop working
We work to keep redirects fast and available but do not promise uninterrupted service. A link may stop working if it is deleted, expires, is disabled for abuse, or if the account's subscription ends. Do not print links or QR codes you cannot afford to lose without keeping your subscription active or a copy of your destinations.
Disclaimer
The service is provided "as is" and "as available" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose and non-infringement. Analytics, location and device data are approximate.
Limitation of liability
To the fullest extent the law allows, we are not liable for indirect, incidental, special or consequential damages, or lost profits, data or goodwill. Our total liability for any claim relating to the service is limited to the amount you paid us in the 12 months before the claim arose. Nothing in these terms limits liability that cannot be limited by law.
Termination
You can stop using xxsml and close your account at any time. We may suspend or end your access for breach of these terms or non-payment. On closure we handle your data as described in the Privacy Policy.
Changes and governing law
We may update these terms; for material changes we will notify account holders by email before they take effect. Continued use afterwards means you accept the update. These terms are governed by the laws of the State of North Carolina, USA, without regard to conflict-of-law rules, and disputes will be heard in the courts located there.
